2nd gear start

My beretta has had this problem off and on since putting the new 3100 in. When coming up to a stop sign or stop light, the tranny will only come down to 2nd gear. About half way through the turn it realizes it's in the wrong gear, then it will down shift into 1st then away you go. It seems to do this more often when the tranny is cold, after warming up it gets better.
Now I have talked with the guy who built the tranny, and he thinks I might have hit the vacuum modulator when I put the new engine in, which it's possible, not likely though. He also said to make sure I have a good, strong vacuum signal from the intake. I replaced all the vacuum lines going to the modulator. I don't know if this helped, went to take the car for a drive this morning and the battery is dead, so she ain't moving till I can get a new battery for it.
So here's the question of the day; if the new vacuum line doesn't help I was told to replace the vacuum modulator, as it could be bad. How is this thing attached to the transmission? I have never messed with one.
BTW, for those of you who don't know your berettas, the transmission I have is the 4T60-e.
